“We” or “CYC” means CreateYourCareer, which is a division of iCon Executive Evolution Pty Ltd (ABN 80 133 989 590).

“Consultant” means the persons or companies engaged by CYC to provide services as specified by CYC.

“Personal Information” means the information provided in any emails or correspondence to CYC and any further details about yourself that you may from time to time, before, during, and after the engagement of services, provide to CYC.

“Rules” means these terms and conditions as are modified from time to time.

No guarantee is made by CYC as to the accuracy, adequacy or completeness of any material which may be provided to you or that the material will guarantee any particular outcome or result.

All warranties are excluded to the maximum extent permitted by Law.

CYC’s maximum liability to you is limited to a refund of the program costs paid by you.

You are granted a non-exclusive right to use any materials provided by CYC for the sole purpose of career searching. You may not copy, hire, charge for, or distribute any of the materials provided.

Personal Information

Personal information about visitors to our site is collected only when knowingly and voluntarily submitted. For example, we may need to collect such information to provide you with further services or to answer or forward any requests or enquiries. It is our intention that this policy will protect your personal information from being dealt with in any way that is inconsistent with applicable privacy laws in Australia.

Use of Information

Personal information that visitors submit to our site is used only for the purpose for which it is submitted or for such other secondary purposes that are related to the primary purpose, unless we disclose other uses in the quotation, or in these Rules, or at the time of collection. Copies of correspondence sent from the web site, that may contain personal information, are stored as archives for record-keeping and back-up purposes only.

Disclosure

Apart from where you have consented or disclosure is necessary to achieve the purpose for which it was submitted, personal information may be disclosed in special situations where we have reason to believe that doing so is necessary to identify, contact or bring legal action against anyone damaging, injuring, or interfering (intentionally or unintentionally) with our rights or property, users, or anyone else who could be harmed by such activities. Also, we may disclose personal information when we believe in good faith that the law requires disclosure.

We may, as required, engage third parties to provide you with goods or services on our behalf. In that circumstance, we may disclose your personal information to those third parties in order to meet your request for goods or services.

We will endeavour to take all reasonable steps to keep secure any information which we hold about you, and to keep this information accurate and up to date. If, at any time, you discover that information held about you is incorrect, you may contact us to have the information corrected.

In addition, our employees and the contractors who provide services related to our information systems are obliged to respect the confidentiality of any personal information held by us.

CYC will always provide an upfront, no-obligation quote prior to engagement of any services.

Where the total quotation amount is greater than $500, CYC reserves the right to request an upfront deposit of 20% before commencing any work.

Full and final payment must be made within seven (7) days of either the completion of a resumé and/or interview coaching session, whichever is appropriate.

Payment may be made either via:

• Direct Debit
• Credit Card (via PayPal’s secure merchant facility)

Cancellations

If you choose to cancel after commencement of your engagement with CYC, we reserve the right to charge a cancellation fee of no more than 25% of the quotation price.

Cancellation prior to commencement of services incur no penalty.

In the unlikely instance of grievous error, inaccuracy, or poor quality on behalf of CYC ,where it can be demonstrated that such errors had a material and monetary impact, CYC will refund you the full cost of any monies paid for services rendered.

We will try to make our website available but cannot guarantee that our website will operate continuously or without interruptions or be error free and can accept no liability for its unavailability. You must not attempt to interfere with the proper working of our website and, in particular, you must not attempt to circumvent security, tamper with, hack into, or otherwise disrupt any computer system, server, website, router or any other internet connected device.

We reserve the right to alter, suspend or discontinue any aspect of our website or the content or services available through it, including your access to it. Unless explicitly stated, any new features including new content and/or the sale of new products and/or the release of new software tools or resources shall be subject to these terms and conditions.
